Card Payment
By booking for you or on behalf of other participants, if paying with a credit or debit card, you are hereby stating that you are the authorized cardholder, or that you have been authorized by the cardholder to use the credit card. In the event the card on the Order Form is dishonored, rejected or later contested for any reason, you agree to pay the amount indicated on the order form to Corporacion de Viajes TAM, S.A.
In no event shall Corporacion de Viajes TAM, S. A. be responsible for any damages arising by reason of your purchase or use of services from Corporacion de Viajes TAM, S.A. In all instances, Corporacion de Viajes TAM, S. A. maximum aggregate liability to you arising by reason of this transaction shall be the amount paid by you to Corporacion de Viajes TAM, S.A.
You agree to indemnify and hold harmless Corporacion de Viajes TAM, S.A., its affiliate companies, and their respective officers, directors, agents and employees against any costs, fines, claims, damages, charges, or fees (including reasonable attorney’s fees) arising by reason of this transaction.
Corporacion de Viajes TAM, S.A. reserves the right to decline the acceptance of an online payment if your credit or debit card is rejected by the bank for any reason.
Pago con Tarjeta
Si paga con una tarjeta de crédito o débito, usted aquí declara que es el titular autorizado de la tarjeta o que ha sido autorizado por el titular de la tarjeta a usarla. Si la tarjeta de crédito o débito que figura en el Formulario de Pedido es deshonrada, rechazada o posteriormente impugnada por cualquier razón, usted acepta pagar la cantidad indicada en el formulario de pedido a Corporación de Viajes TAM, S.A.
En ningún caso Corporación de Viajes TAM, S.A. será responsable de los daños y perjuicios que surjan con motivo de su compra o uso de los servicios de Corporación de Viajes TAM, S. A. En todo caso, la máxima responsabilidad agregada de Corporación de Viajes TAM, S. A. hacia usted, que derive de esta transacción, será el monto que usted pagó a Corporación de Viajes TAM, S.A.
Usted acepta indemnizar y eximir de responsabilidad a Corporación de Viajes TAM, S.A., sus compañías afiliadas y sus respectivos funcionarios, directores, agentes y empleados contra cualquier costo, multas, reclamaciones, daños, cargos u honorarios (incluyendo honorarios razonables de abogados) que resulten de esta transacción.
About Prices
Prices are subject to change. Prices are locked once an order is placed into the cart. The only way to guarantee a specific price is by confirmation of payment when booking the tour. All prices are in US Dollars.
Corporación de Viajes TAM, S.A. reserves the right to conduct tours regardless of weather or environmental conditions. Under any circumstances shall Corporacion de Viajes TAM, S.A. be held responsible for modifications or cancellations due to weather of environmental conditions. No refunds will be given if a tour is cancelled due to weather or environmental conditions.
Corporación de Viajes TAM, S.A. reserves the right to cancel any of its tours to the public without notice. Under no circumstances shall Corporación de Viajes TAM, S.A. be responsible for weather conditions. No tours can be cancelled or amended by any participant at any time based on weather conditions.
Precios
Los precios están sujetos a cambio. Los precios quedan bloqueados una vez que se hace un pedido y este queda finalizado. La única manera de garantizar un precio específico es pagando al momento de reservar el tour. Todos los precios son en dólares americanos.
Corporación de Viajes TAM, S.A. se reserva el derecho de realizar o no tours sin importar condiciones climáticas. No se harán reembolsos si un tour debe ser cancelado debido al mal tiempo. Bajo ninguna circunstancia se entenderá como responsable a Corporación de Viajes TAM, S.A. por la cancelación de un tour por causas climáticas. Los participantes no podrán cancelar o modificar las condiciones de su tour en basados en las malas condiciones climáticas.
Participants Agreements
Corporacion de Viajes TAM, S.A. does not provide medical advice. It is your responsibly to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements which could represent a risk for your health.
You acknowledge that adventures, travels and other products and services offered by Corporacion de Viajes TAM, S.A. may involve a significant amount of risk to your health and safety. By joining the tours you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risk and release Corporación de Viajes TAM, S.A. from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in tours.
In order to participate in any tour which requires physical activities, individuals must disclose any pre-existing medical condition which may impact their ability to participate in the tour. Participants should consult with their professional medical opinion prior to book certain tours that require special physical conditions. Participants must comply with age, weight, physical condition, and other requirements, according to each activity to be performed.
Acuerdo de los participantes
Corporación de Viajes TAM, S.A., no provee consultas médicas. Es su única responsabilidad valorar el riesgo y requerimientos necesarios para participar en un tour, basado en sus propias circunstancias, limitaciones, estado físico y demás requerimientos médicos que puedan representar algún factor de riesgo para su salud.
Usted reconoce que los tours, viajes y otros productos y servicios ofrecidos por Corporación de Viajes TAM, S.A. pueden implicar un riesgo para su salud y seguridad. Al unirse a los tours usted reconoce que ha considerado cualquier riesgo potencial para su salud y seguridad. Usted asume la responsabilidad de todos esos riesgos y libera a Corporación de Viajes TAM, S.A. de cualquier reclamación derivada de cualquier pérdida, daño o lesión o muerte resultante de los riesgos inherentes a los tours.
Para participar en actividades físicas activas, las personas deben consultar previamente con su médico si existe algún problema sobre su capacidad física para tomar nuestros tours. Cualquier condición médica pre-existente que pudiera potencialmente poner en riesgo su integridad durante los tours deberá ser informada a Corporación de Viajes TAM, S.A. Además los participantes deben cumplir con la edad, el peso, la condición física y otros requisitos, según cada actividad a realizar.
Los guías y el personal pueden retirar en cualquier momento a un individuo a partir del inicio de la actividad por las razones que estimen convenientes. No se darán reembolsos como consecuencidas de estos retiros.
Security and Social Responsability
Corporación de Viajes TAM, S. A. has a liability insurance policy which covers the implicitly risks on our tours and it compromises the tourists to follow exactly the norms described in the internal operations rules of Costa Rican law in adventure tourism activities and under the executive law #29421-MEIC-TUR, signed and published on January 3rd, 2001 is in duty to have a waiver signed by any participant or its legal representative.

Corporación de Viajes TAM, S. A. tiene una póliza de seguro de responsabilidad civil que abarca los riesgos implícitos en nuestros tours y compromete a los turistas a seguir exactamente las normas descritas en las reglas de operaciones internas de la ley costarricense en actividades turísticas y, bajo la ley ejecutiva # 29421-MEIC-TUR, firmada y publicada el 3 de enero, 2001 y está en el deber de tener un documento de liberación de responsabilidad firmado por cada participante o su representante legal.
Images and Marketing
You agree that, while participating in any tour, images, photos or videos may be taken by other participants, Corporación de Viajes TAM, S.A. or its representatives that may contain or feature you. By booking the tours you consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to Corporación de Viajes TAM, S.A., its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
Imágenes y Marketing
Usted acepta que, mientras participa en cualquier tour, imágenes, fotos o videos pueden ser tomados por otros participantes, Corporación de Viajes TAM, S.A. o sus representantes que pueden contener su imagen directa o indirectamente. Al reservar los tours, usted acepta y conciente que se tomen tales fotografías y otorga a la Corporación de Viajes TAM, S.A, sus contratistas, subcontratistas y cesionarios una licencia perpetua, libre de regalías, mundial e irrevocable para reproducirla con cualquier propósito (incluyendo marketing, promociones y creación de material promocional por parte de o con sub-licenciatarios), en cualquier soporte, ya sea actualmente conocido o en el futuro, sin ninguna obligación adicional o compensación que se le pague.
Term of Purchase
These terms constitute the entire understanding of the parties with regard to online purchase of the tours. All prior representations, oral or written, and all prior agreements, oral or written, shall be construed according to these stipulations. These terms or any portion hereof shall not be construed against Corporación de Viajes TAM, S.A. by no reason. The parties herein are independent contractors. If any of the provisions contained herein are deemed illegal or unenforceable, such determinations will not affect the validity of the remaining terms and conditions and the remaining terms will continue in force and effect to the fullest extent permitted under applicable law. Purchaser shall not assign any order or interest indicated herein to another party, without the written consent of Corporación de Viajes TAM, S.A. These Terms of Purchase, any forms, quotations, invoices and further information regarding sales terms are incorporated by reference herein and constitute the exclusive and complete Agreement between Corporacion de Viajes TAM, S.A. and you. Provided the Terms of Purchase and any related documents are translated to an alternative language, the Spanish version and any meanings associated with the translation will be interpreted based upon the Spanish version.
Términos de Compra
Estos términos constituyen el entendimiento entre las partes con respecto a su compra. Todas las representaciones anteriores, orales o escritas, y todos los acuerdos anteriores, orales o escritos, son fusionados aquí y deben ser interpretados siguiendo las presentes estipulaciones.
Estos términos o cualquier porción de los mismos no se interpretarán contra Corporación de Viajes TAM, S.A. por ninguna razón.
Las partes en el presente documento son independientes entre sí. Si alguna de las disposiciones contenidas en este documento llegara a ser considerada ilegal o no aplicable, tales determinaciones no afectarán la validez e integridad de los términos y condiciones restantes y los términos restantes seguirán en vigor y efecto en la máxima medida permitida por la ley aplicable. El Comprador no cederá ninguno de los derechos ni obligaciones indicados a otra parte sin el consentimiento previo por escrito de Corporación de Viajes TAM, S.A. Los presentes Términos de Compra, formularios, cotizaciones, facturas e información adicional sobre las condiciones de venta de los tours se incorporan por referencia en este documento y constituyen el exclusivo y completo acuerdo entre Corporación de Viajes TAM, S.A. y usted. Siempre que los Términos de Compra y cualquier documento relacionado se traduzcan a un idioma alternativo, la versión en español y cualquier significado asociado con la traducción se interpretarán basándose en la versión en español.
Change and Cancellation Policy
Changes or cancellations made more than 24 hours prior to the service, are subject to penalty of 25% of the total cost, to cover any expenses incurred. No refund for cancellations made less than 24 hours prior to the service. No shows are penalized with 100%.
If any trip is cancelled due to circumstances beyond our control, a full refund will be provided.
If you wish to change or cancel your tour reservation made online, you must contact TAM at jwsales1@tamtravel.com by 5:00 pm EST.
